1. Scope and provider
These General Terms and Conditions apply to all orders that consumers place with us through the online shop at fruitwarrior.eu.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. Our offer is aimed exclusively at consumers. We do not accept orders from businesses through the shop; for these, please contact us at the email address given above.
We currently deliver to Germany. We will add further countries step by step.
2. Conclusion of the contract
The presentation of the products in the shop is not a binding offer but an invitation to you to place an order.
You put the products you want into the cart and go through checkout to the overview of your order. There you can see all details of the goods, the total price, the shipping costs and the terms of delivery and payment. You can correct your entries up to the last step using the input fields and your browser’s back function. By clicking the button “Order with obligation to pay”, you make a binding offer to conclude a purchase contract. With Apple Pay and Google Pay, you make this offer by confirming the order with an obligation to pay in the respective wallet.
We accept your offer as soon as we successfully receive your payment through the chosen payment service provider. The purchase contract is concluded at that point. You then automatically receive an order confirmation by email, documenting your order and receipt of payment and including your invoice.
We store the text of the contract and send you the order details as well as these terms and the withdrawal instructions by email. The contract is concluded in German.
3. Prices, shipping costs and unit price
All prices are final prices in euros and include statutory VAT. Shipping costs as shown during checkout are charged in addition.
For shipping, we charge a flat rate per order:
- Flat-rate shipping Germany: €5.95, free shipping on orders of €50.00 or more
For products sold by volume, we state the unit price per litre in addition to the final price.
4. Terms of payment
The payment methods offered during checkout are shown to you before you place your order. We offer PayPal and credit or debit card payments, as well as Apple Pay and Google Pay where available on your device. Payment is initiated during checkout; the purchase price is due when the contract is concluded. Merely approving PayPal Express before returning to the final order overview does not yet place an order.
When you pay through a payment service provider, its terms apply in addition. We only receive the information required to process the payment; details can be found in our privacy policy.
If payment is late, the statutory provisions apply.
5. Delivery and delivery time
We ship from our warehouse in Germany. Delivery takes 3 to 7 working days within Germany, counted from receipt of payment. Working days are Monday to Friday, excluding public holidays at our registered office.
We do not deliver to parcel lockers (Packstationen).
If we have not been supplied through no fault of our own, although we had concluded a matching purchase contract with a reliable supplier, we may withdraw from the contract. In this case we will inform you without delay and refund any payments already made immediately. Your statutory rights remain unaffected.
6. Retention of title
The goods remain our property until they have been paid for in full.
7. Right of withdrawal
As a consumer, you have a statutory right of withdrawal. The details and the model withdrawal form can be found in our withdrawal instructions. We also send both to you by email with the order confirmation.
8. Liability for defects
The statutory rules on liability for defects apply. We do not restrict them. For new goods, the statutory limitation period for claims relating to defects is generally two years from delivery. Your statutory rights apply independently of any voluntary guarantees. Further information is available in our notice on your legal guarantee rights.
Please report any transport damage to us as soon as possible. This is not a condition for your rights, but it helps us to assert the claim against the carrier.
9. Vouchers and discount codes
We issue promotional vouchers free of charge as part of promotions. They can only be redeemed within the stated period and only once per order; several vouchers cannot be combined unless stated otherwise. Individual products or product groups may be excluded from a promotion.
The voucher value is neither paid out nor does it earn interest. Any remaining balance is forfeited if the order value is lower than the voucher value. If the voucher does not cover the order, you can pay the difference using the payment methods offered.
If you withdraw from the order in whole or in part, we refund the amount actually paid. A redeemed promotional voucher is not reinstated if the promotion has ended.
10. Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
If there is a problem with your order, please contact us directly. As a rule, it can be resolved quickly and without red tape.
11. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If your habitual residence is in another country, the mandatory consumer protection provisions of your country of residence remain unaffected by this choice of law. These terms therefore do not take away any protection that your national law gives you.
